Can someone explain to me how an employer can be sued if a group of employees find out another employee was arrested for posession of marijuana? Sure the group of employees were laughing at the mug shot online. Sure the group of employees think the person is an incompetent bufoon that should have been fired a year ago. But, the group of employees did not harass the person. Somehow the person found out that other people knew and went to the boss. Now the boss is afraid of being sued.
What’s especially interesting about this is that when complaints were made regarding this same person’s inappropriate workplace conversations no action was taken. He didn’t seem too afraid of a sexual harrasment lawsuit then. What’s the definition of a “hostile workplace”? Personally I think having your boss threaten to fire you if you miss an impossible deadline creates a hostile work environment.
